Genesis Tax 121 LLC is the exclusive owner of all data gathered through our website. We collect only the information necessary to prepare your tax return and provide our services (data minimization principle). This includes names, Social Security numbers, dates of birth, mailing and email addresses, bank account details, and other tax-related data ("personal information"). Payment information is collected only when a purchase is made. When customers reach out for support, we may also collect contact details such as phone numbers to assist in resolving their inquiries.

We also collect technical data about your internet connection, IP address, and site usage through automated tracking tools described below.

Legal Basis for Processing Your Data (GDPR Article 6)

Genesis Tax 121 LLC is a U.S.-based entity that processes personal data of individuals located in the EU and EEA. In accordance with Article 27 of the GDPR, Genesis Tax 121 LLC has appointed DataRep as its Data Protection Representative in the European Union and European Economic Area. Cross-Border Data Transfers

Your personal data is stored on servers located in the Netherlands, which is within the EU and therefore subject to GDPR protections. Where your data is transferred to or accessed by systems or personnel outside the EU/EEA — including our U.S.-based operations and third-party service providers — we ensure appropriate safeguards are in place, which may include Standard Contractual Clauses (SCCs) adopted by the European Commission, data processing agreements with our service providers, or other transfer mechanisms recognized under applicable law. By using our services, you consent to such transfers to the extent they occur.

Data Security

We maintain physical, electronic, and administrative safeguards that comply with applicable federal standards, including those required under the Gramm-Leach-Bliley Act (GLBA), 15 U.S.C. §§ 6801–6809, and the GDPR. All sensitive information submitted through our site is protected using SSL (Secure Socket Layer) encryption, both during transmission and in storage. Account access is protected by user-selected login credentials, and we also employ Multi-Factor Authentication (MFA). Only you — or someone you've shared your credentials with — can access or modify your account.

Access to user data offline is restricted to select personnel who require it for specific job functions. All employees receive regular training on privacy and security practices, including reminders before each tax season and whenever new policies are introduced.

Important: You are solely responsible for maintaining the confidentiality of your login credentials. Genesis Tax 121 LLC shall not be liable for unauthorized access resulting from your failure to secure your credentials.

Data Breach Notification

In the event of a security breach involving your personal information, Genesis Tax 121 LLC will comply with all applicable breach notification obligations, including:

Wyoming Data Breach Notification Act (Wyo. Stat. §§ 40-12-501 to 40-12-502) — affected users will be notified without unreasonable delay where misuse of personal information is reasonably likely.

GDPR Article 33 — where applicable, we will notify the relevant supervisory authority (Autoriteit Persoonsgegevens) within 72 hours of becoming aware of a breach likely to result in risk to your rights and freedoms.

GDPR Article 34 — where a breach is likely to result in high risk to your rights and freedoms, we will notify you directly without undue delay.

GLBA Safeguards Rule — we comply with FTC breach notification requirements applicable to financial institutions under GLBA.

Notification will be delivered via direct written notice, email, or, where permitted by law, substitute notice through conspicuous website posting.

Genesis Tax 121 LLC maintains comprehensive security measures designed to prevent breaches. In the event a breach occurs despite these safeguards, we will take immediate steps to contain the incident, investigate the cause, and implement corrective measures to prevent recurrence. Nothing in this section limits our obligations under applicable breach notification laws, including the GDPR and the Wyoming Data Breach Notification Act.

Data Protection Impact Assessments

Where our processing activities are likely to result in a high risk to the rights and freedoms of individuals — particularly where we process sensitive financial data using AI or automated tools — we conduct Data Protection Impact Assessments (DPIAs) in accordance with GDPR Article 35. These assessments evaluate the necessity and proportionality of processing, identify potential risks to data subjects, and document the technical and organizational measures we implement to mitigate those risks.

DPIAs are reviewed and updated periodically, including when there are significant changes to our processing activities, technology, or the regulatory environment. Results of DPIAs inform our data protection practices and are available to the relevant supervisory authority upon request.

Third-Party Data Processors

We share your data with third-party service providers only to the extent necessary to deliver our services. Categories of third-party processors we currently engage include payment processors (for credit card transactions), cloud infrastructure and hosting providers (for data storage in the Netherlands), analytics service providers (for anonymized usage data), advertising platforms (for retargeting as described below), and customer support tools. We do not share personally identifiable information or tax return data with advertising partners.

All third-party processors are contractually required to handle your data in compliance with applicable law, including GDPR where applicable. Where required by GDPR Article 28, we maintain Data Processing Agreements (DPAs) with our processors. We do not authorize our processors to use your data for any purpose other than providing services to us. We are not responsible for the independent data practices of third-party websites linked from our platform.

Data Storage

All data is stored on servers located in the Netherlands, within the EU, and is processed in compliance with the GDPR. By using our services, you expressly consent to the storage and processing of your data in the Netherlands.

Service Eligibility: This platform is designed and intended exclusively for individuals who are not residents of the United States. Our services, including tax return preparation and filing assistance, are tailored to the needs of foreign nationals and non-U.S. persons with U.S. tax obligations. We do not market to, target, or intend to serve U.S. residents.

By creating an account or using our platform, you represent that you are not a U.S. resident. If we determine that a user is a U.S. resident, we reserve the right to suspend or terminate their account and cease providing services. Genesis Tax 121 LLC disclaims responsibility for any consequences arising from a user's misrepresentation of their residency status, including but not limited to inaccurate tax filings or regulatory non-compliance.

Business Transitions

If Genesis Tax 121 LLC undergoes a business transition — such as a merger, acquisition, asset sale, or bankruptcy proceeding — user data may be transferred as part of that transaction. We will notify affected users via email or a prominent website notice as required by applicable law. If the transition results in a material change to how your data is used, you will be informed consistent with our policy update procedures.

Data Retention

We retain all collected data for a maximum of eight (8) years from October 31st of the IRS tax filing year in which the return was due, consistent with U.S. tax recordkeeping requirements. Where GDPR applies, we retain data only for as long as necessary for the purposes for which it was collected, subject to our legal retention obligations.

Online access to the tax application is available for the current year and the seven prior tax years. Data is permanently deleted after October 31st of the eighth year following the applicable IRS filing deadline, regardless of when the return was actually submitted.

Examples:

  • A 2025 tax return (IRS deadline in 2026) will be retained until October 31, 2034.
  • A 2018 tax return (IRS deadline in 2019) will be retained until October 31, 2027, even if filed in a later year such as 2026.

Document import and storage features are subject to this same retention schedule. You remain solely responsible for maintaining your own permanent copies of records you wish to preserve. Genesis Tax 121 LLC shall not be liable for any loss of data after the applicable retention period expires.

Usage Data

We use log files and analytics tools to monitor site activity. Data collected may include IP addresses, device types, unique identifiers, browser information, referring and exit pages, and click counts, used in aggregate to improve site performance. This data is anonymized where possible and is not used to identify individual users.

Cookies and Tracking Technologies

We use cookies and similar technologies to manage the site, analyze usage patterns, and enhance the user experience. We categorize cookies as follows:

We partner with third-party advertisers to display our ads across the web based on your browsing activity on our site. We do not upload customer lists to these partners and do not share personally identifiable information or tax return data for advertising purposes. If you complete a significant action on our site — such as making a purchase or creating an account — we may work with our partners to stop showing you retargeting ads.

You can opt out of personalized ads through Google Ads Settings, the Digital Advertising Alliance at optout.aboutads.info, or the Network Advertising Initiative at optout.networkadvertising.org. We honor Do Not Track (DNT) browser signals by disabling all non-essential tracking cookies for users whose browsers send a DNT signal. Users with DNT enabled may still see non-personalized ads.

Artificial Intelligence and Automated Processing

When you upload or import digital documents, the information may be processed using AI and/or manual review. AI may help extract and organize data, but all outputs are presented for your review before any changes are applied to your return. You are solely responsible for verifying the accuracy of all information before filing. Genesis Tax 121 LLC is not liable for errors in your filed return resulting from your failure to review AI-extracted data prior to submission.

We may use anonymized data to improve our AI models but do not share customer data or trained models with third parties. We do not use your personal data to train AI models without your consent. AI may also be used to detect misuse or abuse of our platform.

Communications

We use your contact information to provide return status updates, tax deadline reminders, payment confirmations, and customer support. Please keep your contact details current. Genesis Tax 121 LLC is not responsible for missed communications resulting from outdated contact information.

Optional promotional communications may be sent from time to time. You may opt out at any time by adjusting your account preferences, clicking "Unsubscribe" in any promotional email, or visiting MyFreeTaxAmerica.com/unsubscribe. Operational service notices are not subject to opt-out.

Customer Support

Support is provided via email and in-app messaging. You may update or correct your personal information by logging into your account.
